1. Scope of application

The business purpose of TronicSale is the mail order trade (e-commerce) via a web shop. The business license includes the following divisions:

i. Trading with all kinds of goods; section mailorder business and e-commerce

ii. Services for electronic data processing

Shipments and services by Christian Harzl (consequently TronicSale) to costumers take exclusively place on the basis of the following Terms and Conditions.

2. Conclusion of an agreement

2.1 Contracting parties are the costumer and TronicSale, Bierbaum 44, 8141 Zettling, Austria. Proprietor: Christian Harzl.

2.2 By ordering goods the costumer submits a binding offer. The costumer’s submission becomes effective as soon as the order arrives at TronicSale.
2.3 You can contract in english and german language.

3. Misprints

Mistakes in writing and misprints can’t be excluded.

4. Prices and terms of payment

4.1 The prices are always quoted gross (inclusive of 20% VAT). On the account the VAT (value added tax) is shown separately.

4.2 Just the prices which are valid at the time of the order are significant. By updating the Internet pages from TronicSale all of the previous prices and details on goods become invalid.
For packing and shipment separate costs incur. You can see them in the heading “Shipment” in our shop.

4.3 The payment will be made by bank transfer in advance, credit card (via moneybookers), PayPal or cash on delivery.

5. Cancellation of a contract / withdrawal

5.1 Any costumer has the right to revoke his contractual statement within 14 calendar days without stating reasons by returning the goods. The cancellation period starts with the goods’ delivering at the costumer. For the observation of the cancellation period it’s enough to send the goods back on time.

5.2 The right of cancellation does not exist

Any costumer has the right to revoke his/her contractual statement within one month without stating reasons in writing (e.g. letter, e-mail) or by returning the goods. The period starts at the earliest with the receipt of the goods and this instruction in writing. To observe the period the notice of cancellation or the goods must be received on or before the appropriate date. The cancellation has to be addressed to:

Exclusion from cancellation

The right of withdrawal does not exist for contracts about shipping data media or software if the delivered data media have been unsealed or registered by you as well as it is the case with electronic devices (e.g. GPS), which have been registered on the producer's page.

Consequences of the withdrawal

In case of an effective cancellation the mutually received goods and services have to be returned and possible benefits (e.g. interests) have to be refunded. If you cannot return the received performance at all, just partially or in defective conditions, you have to pay compensation for the value.
This does not apply to surrender of goods, if the good's degradation exclusively traces back to its inspection, like it would have been possible for you in a retail shop.
Besides, the customer can avoid the obligation to compensate for the decrease in value due to an deterioration resulting from his using the goods in accordance with their intended purpose by not using the goods as if they were his property and by refraining from any action that might reduce the goods' value.
Items that can be shipped via package have to be returned. Items that cannot be shipped via package will be picked up at yours. You have to pay the costs for the return

6. Conditions of shipment

6.1 Shipments take place to the shipping address given by the costumer (not to the billing address).

6.2 The delivery period arises from the electronic catalogue. Details on delivery periods are listed in the product description. "Lagernd / in stock" = within 24h, other periods are listed.

6.3 If TronicSale falls behind with shipment because of reasons, which they have to represent, or becomes a delivery impossible out of these reasons, without TronicSale being accused of purpose or gross negligence, the liability for damage by TronicSale is excluded. Further requirements by the costumer will remain unaffected. In particular the costumer can cancel the contract by setting an adequate respite.

6.4 In the case of delays in shipment that have not to be represented by TronicSale (force majeure, third party default, etc.), the delivery date will be extended appropriately. The costumer will be informed immediately. When the reasons for the delay last longer than 4 weeks from the conclusion of the agreement on, each of the parties has the right to cancel the contract.

7. Reservation of proprietary rights

The ordered goods stay the ownership of TronicSale until the full payment.

8. Damages in transit; Examination and Notice of Non-Conformity of the consumer

In the case that goods are delivered with obvious damages of the packing or of the content, the costumer has to complain at the forwarder/cargo-ship immediately and refuse acceptance. Besides, TronicSale has to be contacted immediately so that the goods can be exchanged.

9. Guarantee

9.1 The warranty claims by the costumer against TronicSale in the case of defects of the delivered goods act in accordance with the legal requirements, as far as no aberrations arise due to following regulations. The warranty period ends after 24 months after the delivery.

9.2 Defects caused by improper measures or arrangements contrary to contract when locating, connecting, operating or shelving of the goods, do not give reasons for demand against TronicSale. The infringement of contract and improper arrangements are particularly specified after the producer’s specifications.

9.3 Warranty claims just can be asserted by presenting the bill (at least a copy). Warranted products can be given to the producer either by the costumer or by TronicSale. An instant exchange is impossible as a rule and a written confirmation by the producer is needed.

10. Liability

10.1 TronicSale is just liable for defects when they have been caused purposely or grossly negligent by TronicSale or their assistants. TronicSale is liable for injury to persons in the case of any culpable causation by TronicSale or their assistants. TronicSale is not liable for damages caused by improper utilization of goods.

10.2 It is incumbent on the costumer to arrange for his data's assurance. TronicSale is not liable for the costumer's data loss on storage media (hard disks, storage media, etc.) bought by TronicSale, unless the data loss has at least grossly negligent been caused by TronicSale or their assistants.

11. Data protection

We are pleased about your interest in our website. The protection of your privacy is very important for us. Below we inform you in detail about the handling of your data.

Collection, processing and utilisation of personal data
You can visit our homepage without giving any personal particulars. We just record access data without personal references such as your Internet service provider's name, the page, from where you visit us or the requested file's name. These data are exclusively analysed to improve our offer and they don't allow to determine your identity. Personal data are just recorded when you voluntarily transfer them to us within the framework of your order, the opening of an account or the registration for our newsletter. We exclusively use your transferred data without your separate consent to fulfill and carry out your order. After a complete processing of the contract and the purchase price's complete payment your data will be blocked for further usage and after expiration of the retention period in terms of commercial and fiscal law they will be deleted unless you have not explicitly agreed to a further use of your data. When applying for the newsletter your e-mail address will be used for own announcements until you sign off. The deregistration is possible at any time.

Usage of Cookies
On different pages we use cookies to design our website attractively and to allow the utilisation of certain functions. These are small text files which are stored on your computer. Most of the cookies we use are deleted by finishing the browser session (so called session cookies). Other cookies remain on your computer and allow us to recognise your computer when you visit us the next time (so called durable cookies). Our partner companies are neither allowed to collect personal data via our website nor to process or use them.

Circulation of personal data
Your personal data are transferred to the mail-order establishment which is commissioned with the shipment (POST.at), as far as this is necessary for the goods' shipment. For payment processing we transfer your payment data to the credit institution which is commissioned with the payment.

Right of access to personal data
You have the right of gratuitous access to your stored data such as the right of rectification, blocking or deletion of these data.

You maybe gave us the agreement to receive a newsletter from us. We want to refer, that you can unsubscribe our newsletter easily. "I would like to subscribe to the newsletter. It is possible to unsubscribe at any time." At the end of every newsletter you have a link "unsubscribe"

12. Invalid articles

If one or more regulations of these Terms and Conditions are invalid, that does not mean the invalidity of the whole contract.  The invalid regulation will be replaced by the appropriate legal regulation.

13. Special regulation: Feedbacks on eBay and Amazon

Costumers, who obtain goods via our eBay account, respectively our eBay shop or via our Amazon shop, are entitled to evaluate our performance at eBay and Amazon.

If the costumer gives a bad evaluation without having contacted us and respectively without giving us the chance to reconcile the differences (money back guarantee, exchange of the goods, etc.) or if he evaluates us negatively unjustified, TronicSale is entitled to claim for defamation of their reputation, for circulation of untruth and for damages.

We are always keen to find a 100% satisfying solution for our costumers, so please stay fair when evaluating and do not evaluate hastily negative in the heat of the moment.

14. Jurisdiction and applicable law

In any case the place of jurisdiction is Austria (Graz); place of business.
